Madlobos Rent a Car  - Car Rental, Sociedade Anonima (S.A) (hereinafter referred to as Madlobos Rent a Car) with its registered office at Caminho da Bela Vista 5, 9300-027 Camara de Lobos Madeira - Portugal, rents to Pessoa(s) identified(s) in the Rental Agreement (hereinafter referred to as "Customer" or "Driver") means the vehicle described in the Rental Agreement (hereinafter referred to as "Vehicle") in accordance with the Rental Terms and Conditions described below and or in any annex in which the Customer knows and accepts and, after signing, undertakes to observe and respect.

1.  Age and category of driving licence

The Driver must be at least 18 years old and have a valid driving licence;

2. Reservations

Madlobos Rent a Car will always make every effort to provide the vehicle booked for the rental period. If for reasons of force majeure Madlobos Rent a Car is unable to supply a vehicle from the reserved group, another equivalent or higher range vehicle may replace the reserved group vehicle. In case the replacement vehicle fare is higher than the vehicle of the group car initially booked by the Customer, this difference will be borne by Madlobos Rent a Car.

3. Removal and delivery of the vehicle

The collection and delivery of the vehicle have to be done at the address, day and time specified in the Special Conditions of the Vehicle Rental Agreement. The return of the vehicle in another Service Station may imply the charge of an extra.

If the Customer wishes to extend the rental period, he must inform Madlobos Rent a Car at least 24 hours in advance. Depending on the fleet’s availability, Madlobos Rent a Car may or may not authorize the extension of the rental period.

If the extension of the rental period is not requested and the vehicle is not returned at the address, date and time stipulated in the Rental Agreement will be considered illicit use of the vehicle and Madlobos Rent a Car booking if in the right to charge an amount calculated on the basis of triple of the daily counter rate practised.

4. Responsibilities of Madlobos Rent a Car

Madlobos Rent a Car has to deliver the vehicle in good condition and maintenance and in safe conditions of circulation. The Customer must receive all the documentation of the vehicle (Certified or Original Photocopy of the Single Circulation Document, Green Letter of Insurance and Friendly Statement), as well as the accessories/related contracted.

Madlobos Rent a Car must check and register in form, to be delivered to the Customer, the damage existing in the vehicle upon its delivery.

5. Responsibilities of the Client

The Customer is responsible for ensuring that he has a valid driving licence to drive the vehicle he proposes to rent. The originals of the Driving Licence and Identity Card or Passport must be presented by the Customer.

During the rental period, the Customer is responsible for all fines and violations of the Highway Code or other violations of the law. Madlobos Rent a Car is responsible for informing the Customer’s Identity or giving other information to the Portuguese or Foreign Authorities whenever requested.

It is the Customer’s responsibility to ensure that the rented vehicle:

• Will be used according to the manufacturer’s recommendations;

• It will be used in full compliance with the Highway Code of the country in which it circulates;

• Will not be used negligently;

• will not be used in sporting or other competitions;

• will not be used off-road or conventional roads;

• will not be used for illegal reasons;

• shall not be used with a weight greater than its authorised capacity;

• Will not be driven by anyone who is not listed in the Rental Agreement;

• will not be used if its mechanical condition is considered unsafe;

• will not be used on the effect of alcohol, drugs or other narcotic substances;

• Will not be used if the Client’s physical condition is weakened by illness or tiredness.

Failure to comply with any of the above paragraphs involves immediate cancellation of Insurance making the Customer fully responsible for the total value of the vehicle.

6. Insurance

The rental rate includes the following insurance coverage:

• Mandatory Civil Liability;

• Travel assistance (Continental Portugal and in Agreed Countries);

• Own damage.

• Damage to third parties

• CDW

• Franchise 0%

• SCDW

In no situation does Self Damage coverage cover damage or loss of rented accessories such as GPS, baby seats, etc.

7. Return policy

Refunds of payments made are automatically issued when the request for cancellation of the reservation is made. Whenever possible, the return must be done by the same payment route, but if it is not possible, the User must present proof of payment and Account or Card Ownership, in order to make the return by bank transfer.

Madlobos Rent a Car undertakes to return all amounts received (except bank or other fees and the Reservation Cancellation Supplement) within a maximum of 30working days.

No refund will be made if the rental ends earlier, if the Customer does not attend to pick up the vehicle or if the reservation is cancelled less than 48 hours in advance.

8. Fuel policy

The Customer must return the fuel at the same level as Madlobos Rent a Car.

Madlobos Rent a Car does not return any excess fuel value

In case the customer does not return the fuel at the same level that was delivered to him, Madlobos Rent a Car reserves the right to charge 100 euros for the fuel fee.

9. Mechanical breakdown

In the situation of mechanical breakdown, the Customer must contact Madlobos Rent a Car and Travel Assistance through the numbers (+351) 937 30 4126 (+351) 800 201 833 (in case the policy is Allianz Portugal and is in Portugal) or (+351) 213 129 210 (in case the policy is Allianz Portugal and if you are abroad), informing its exact location and detailing in the best possible way the type of breakdown. If repair is not possible, Madlobos Rent a Car or Travel Assistance shall endeavour to replace the damaged vehicle in the shortest possible time.

10. Geo-referencing equipment

The Customer understands that the vehicle may be equipped with a georeferencing device that can be used in case of non-compliance with the Rental Agreement, theft or crossing borders.

11. Payments

All transactions made through the Madlobos Rent a Car website, whether by ATM, Paypal or direct payments via credit or debit cards (Visa and Mastercard) are processed by third parties.

12. Disputes

In case of a dispute between the Customer and Madlobos Rent a Car, this will be regulated in accordance with the Portuguese Laws. Both the Customer and Madlobos Rent a Car agree to establish the OPORTO County court to resolve any disputes arising from the Rental Agreement or else the Customer may resort to an Alternative Dispute Resolution Entity for Consumer Disputes.
